摘要
"多哈宣言"列举的一系列新一轮多边贸易谈判的议题当中,TRIPS协议与《生物多样性公约》、传统知识和民间文学保护的关系是其优先考虑的问题之一。对植物新品种提供一种不同于专利制度的保护方式,TRIPS协议与《保护植物新品种国际公约》均考虑到了植物新品种保护上的特殊之处;在动植物基因资源的保护与利用方面,TRIPS协议与《生物多样公约》也应该不存在冲突;对传统知识和民间文学的保护,仅从知识产权制度的角度分析,存有一定障碍,值得我们深入探讨。
In a series of latest MTN topics for discussion enumerated in the Doha Declaration, the relationship between TRIPS Agreement and the protections of CBD, traditional knowledge and folklore becomes one of the most urgent problems. It presents a protective way for new plants which is different from the ways of patent system. Both TRIPS Agreement and International Convention for the Protection of New Varieties of Plants take the special aspects of new plants protection into account. As far as the protection and utilization of the gene resources of animals and plants are concerned, TRIPS Agreement and CBD shouldn't have any conflicts. As for the protection of traditional knowledge and folklore, there exist certain barriers if it is analyzed merely from intellectual property rights system, which is worth exploring and discussing.
