摘要
处理医疗事故与医疗纠纷的问题使医与法的矛盾突现。具体表现在逮捕当事医务人员 ,判刑不公 ,巨额赔偿使医院不堪重负 ,少数新闻媒体的炒作导致医患关系紧张 ,等等。同时由于《医疗事故处理办法》的法律效力明显低于《民法通则》,法学界用《民法通则》来解释《医疗事故处理办法》并以此为依据处理 ,势必造成医与法的矛盾。为此 ,尽快建立《医疗事故法》,限制新闻媒体的片面炒作 ,各级医院加强医德医风及法制教育 ,是解决医与法矛盾的当务之急。
Contradiction between m edical profession and law is revealing increasingly itself as the matters of m edical ac- cident and diaputes are to be handled precisely.The contradiction is displayed in the following situations:w hen the medical personnel get arrested and are put under unjust sentence,when they are sentenced to a huge am ount of com pensatory damage that hospitals cannot bear and w hen the m inority of news m edia stir up com m otion,straining relationships between the pa- tients and medical workers.Moreover,'Regulations of H andling Medical Mistakes'is m uch of low legal status,com pared with 'General Rules of Civil L aw'. When the latter is quoted to interpret the former and m anagem ent of m edical accidents is based on the Civil L aw,these w ill undoubtedly bring about contradictions between medical field and the law.Therefore,the top priority task is to make the related legislations,to restrict news m edia on taking one-sided approach to the problem s and to strengthen medical etheics and education in legality at hospitals of various sizes so as to solve this type of contradiction.
