摘要
伴随着现代商标功能的转变,对于驰名商标的保护也经历了一个从混淆保护到淡化保护的过程。淡化理论本身既具有法理学基础,又符合商品经济的发展趋势,加上美国和欧盟在这方面立法上的成功经验,所以很多学者都认为,此次修改《中华人民共和国商标法》(以下简称《商标法》)修改中应引入此理论。但综合分析我国国情及驰名商标认定的现状,《商标法》的宗旨与国家知识产权战略要求,目前引入淡化理论还为时过早,不会起到相应的积极作用。建议此次修改中完善驰名商标特殊保护的重点工作还应是进一步加强混淆保护制度,并在此基础上为今后的淡化理论植入做铺垫。
As the changing of the modern trademark＇s function, the protection of the well-known trademark goes from confu- sion protection to dilution protection. The dilution theory has its own jurisprndenee＇s basis, and suits to the current trend of commodity economy Because of the successful experience of US and EU, many domestic scholars believed that we should implant this theory during the process of revising PRC Trade mark Law. But under the analysis of our nation＇s conditions, the purpose of Trademark Law, the situation of well-known trademark decided, and intellectual property strategy, the author thinks that it＇s too early to implant the dilution theory. It is suggested that the founs on improving well-known trademark should be to strenythen confusion proteetin system, which makes preparatin for the futnre implanting dilution theory.
