摘要
美国退出《京都议定书》不仅不利于全球气候变化问题的解决,其自身也因此受到国际社会的普遍谴责。理性主义的解释和现有的规范研究都无法很好地回答美国拒绝接受国际气候规范这一现象,对于与国内规范结构契合的国际规范的接受问题也尚无深入分析。为此,本文引入"行为体策略"概念,认为行为体可以采取语言框定、权威联盟和替代选择三个策略,通过分离国际规范在国内的合理性和合法性,成功挑战与国内规范结构契合的国际规范的合法性,以阻止规范传播。
Not only was America's withdrawal from the Kyoto Protocol disadvantageous for resolution of the problem of global climate change, it was also met with the universal criticism of the international community. Rationalist explanations and contemporary scholarship on norms are not able to explain why the United States would reject an international norm with respect to the climate. At the same time, scholars have yet to analyze in detail the problem of fit between domestic regulatory structures and international norms. This article borrows from the concept of "actor strategy", which holds that actors can apply three strategies: language framing, authority union and alternative choice to deviate from the legitimacy and legality of international norms domestically and successfully challenge the structural fit of international norms with domestic norms. This functions to prevent the spread of norms.
