摘要
高房价已经成为困扰我国民生发展之大问题。从法理学的角度分析高房价发生的原因及其不合理性,指出高房价违背市场规律,违背社会上多数人的利益和期待,违背人们的社会正义感,并在此基础上从住房权的视角对此给予充分的反思,且在考察列国关于管制高房价的经验的基础之上,提出保障住房权的法律制度体系构想十分必要。
The high housing price has become a predicament and obstacle as for people＇s livelihoods and development.From the perspective of jurisprudence,this paper analyses the cause of high housing price which is unjustifiable and runs counter to the rule of market,as well as the majority＇s interest and expectation,even the social just.Further,the paper reflects the housing right and propose that the safeguard system of housing right should be established based on current practice of regulation on high housing price.
