摘要
学术界对当代中国根本政治制度的看法不尽一致。从政治制度自身的内在逻辑来看,宪法属于政治制度;从历史生成逻辑来看,现代宪法(或现实宪法)早于现代国家而产生,也早于其他国家政治制度而产生;从与其他政治制度的确立和权力授受逻辑关系来看,宪法是人民代表大会制度的法律依据;从自身内容来看,宪法是当代中国其他一切重要制度的法律依据。宪法是当代中国根本政治制度。
There exists disagreement with the fundamental political system of today＇ s China. In our opinions, we must illuminate it by constitution in the background of ＂rule of law＂. From its inner logic, constitution is political system. From the historical logic of political system, constitution origins earlier than modern country and other political systems. From the power handover and takeover logic, constitution is the bases of any other politics systems. From its own content, constitution macroscopically stipulates all the important systems of today＇ s China. Constitution is the fundamental political system.
