摘要
歧视性招聘广告作为我们社会的一大顽症,不仅在以公开的方式挑战社会平等秩序,而且还直接侵害了公民的基本宪法权利——劳动权,必须加以治理。解决问题的复杂性在于其涉及多个法律部门,是一个系统化的工程。这一系统的基本构造应该是:以就业促进法为核心,建立具有可操作性的用工歧视标准;以广告法为主体,通过扩大广告法的适用范围,建立招聘广告的审批制度;通过适当调整劳动仲裁以及民事诉讼受案范围,实现权利的法律救济。
Discriminatory want ad, as a chronic and stubborn disease of society, not only challenges the equal public order openly, but also infringes upon citizen' s constitutional right - right to work, which should be brought under control. The complexity of the problem is that it deals with a variety of law departments and is a systematic project. The system should be established as follows : with the Law on Promotion of Employment as the core, it' s necessary to set an applied criterion about discrimination in employment; with the Advertisement Law as the main part, it' s important to es- tablish the examination and approval system of the want ad by broadening applicability of Advertisement Law; and it's necessary to realize legal right relief by adjusting the scope of accepting and hearing cases in labor arbitration and civil lawsuit.
