摘要
环境权是环境法的一个核心问题,自然人环境权又是环境权体系中一项最基础、最重要的环境权,对个体环境权的保护,是实现整体环境权的基础。自然人环境权包括实体性自然人环境权与程序性自然人环境权。实体性自然人环境权是一个由多种子权利构成的权利体系,它包括环境人格权、环境需求权、环境安全权、环境经济权和环境精神权,具有丰富的内涵,从法律上确认、保障实体性自然人环境权具有重要的意义。
The environmental right is a core problem in the environmental law, the environmental right of the natu- ral person is one of the most basic and rights in the environmental rights system, and the protection for the individual environmental right is the foundation to achieve the overall environmental right. The environmental right of the natural person comprises the entitative environmental right and the procedural environmental right. The entitative environmental right of the natural person is a compound rights system, which comprises the environmental personality right, the envi- ronmental demand right, the environmental security right, the environmental economic right and the environmental spirit right. It is rich in content, and is of great significance to legally confirm and protect the entitative environmental right of the natural person.
