环境有五个主要的功能。基于这五个主要的功能来分析环境权的权能，可以得出：个人环境权包括清洁水权、清洁空气权、宁静权、 景观美感权，以及程序上的环境诉讼权。企业环境权没有存在的必要和根据。国家环境权有存在的根据，包括对内的环境管理权和对外的免 受跨界污染的权利。
The environmental rights are more and more important basic rights for citizen,but what specific rights contained in the environmental - rights is not to be clear. In fact, speaking of individual, the environmental rights are refered to the people to be authorized to drink the clean water, breathe the clean air, enjoy the peaceful living conditions, watch the beautiful scene, when the environment suffers destroys, the correlation persons have the right to file the public welfare lawsuit to the troublemakers. Speaking of the country, the environmental rights include the environment authority for homeland and exemnting pollution from foreign countries.Enterprise environmental rights don＇t have the existence necessity and basis.
