摘要
我国现行农业国内支持制度存在的突出问题是"政策至上,法律基础薄弱"。从促进农业发展、保护农民和纳税人利益以及规范政府农业国内支持行为等角度出发,非常有必要将农业国内支持制度法律化。农业国内支持制度的法律化,需要遵守适度支持、区域协调和符合国际义务等原则。从长期看,我国应当建立以《宪法》为根本法,以《农业法》为基本法,以《农业国内支持法》为特别法,辅之以相关条例和实施细则以及部门规章和地方性立法的农业国内支持法律体系。
In the construction of Chinars agricultural domestic support system, the preference to policy has become a fatal problem which should be solved immediately. In order to promote the development of agriculture, protect the interests of farmers and taxpayers, and regulate the behavior of the government, it is pressing to establish and perfect the legal system of agricultural Domestic Support. In this process, there are three principles that should be born in mind, which include, interalia, （1） moderate support; （2） harmonizing different rural areas with individual development levels; （3） in conformity with China＇s international obligations under the WTO. In the long run, a legal system of China＇s agricultural domestic support must be established. In this system, the Constitution Law is the fundamental law, and Agricultural Law or Farm Bill would be the primary law, and Agricultural Domestic Support Law is the special law which regulates the comprehensive domestic support projects, from the approval, the implementation, to the completion and the following check and final acceptance.
