摘要
在我国,实务上之商品房按揭并未转移所有权。鉴于英美法国家(我国香港)对传统意义Mortgage制度之扬弃,淡薄所有权转移观念而趋向大陆法的抵押制度;即便大陆法,不动产让与担保也仅在小范围内适用,故我国不宜规定不动产让与担保。而我国的商品房按揭可作为一种特殊的抵押予以规制,这比让与担保更为优越。
The buyer's ownership of commercial building is not transferred to bank in legal affairs in China. The traditional mortgage is discarded in common law countries, and the concept that the ownership of commercial building should be transferred is decreasing, mortgage is more likely pledge of commercial building. Even in Europe, German, Japan, sicherungskauf is applied in small scope. It is not necessary for us to stipulate sicherungskauf in law, we can regard mortgage as a special pledge of commercial building in law.
