摘要
科学侦查的主要表现形式是技术性侦查。技术性侦查本质是一种以物证技术及信息为基础并以证据为中心的侦查方式。对技术性侦查的概念可从历史渊源、学理依据、诉讼法理以及实践依据四方面加以剖析。剖析技术性侦查的概念,有利于理解技术性侦查系统,促进技术性侦查理论的发展与实践。
Scientific Investigation＇s major appearance is considered as technical investigation. The essential of the technical investigation is that it is a crime detection measurement based on physical-evidential-technology. We can review the concept oftechnical investigation from historical source aspect, doctrinal aspect, legal aspect and practical aspect. Analyzing the concept would be helpful to understand technical investigation system and promote the development and practice of technical investigation.
