摘要
侦查学的逻辑起点是指侦查学知识体系中最抽象、最一般、最简单、最普遍的,孕育着侦查学全部内容、作为侦查学理论推演和体系构建的"胚胎"的范畴。围绕侦查学逻辑起点问题进行的探讨,从源流和发展脉络上,有犯罪行为说、刑事案件说、刑事侦查说、犯罪事实的自然属性与社会人文属性二重性命题说四种观点。犯罪行为说有悖于学科逻辑起点的特有性和排他性原则;刑事案件说和犯罪事实的自然属性与社会人文属性二重性命题说有悖于学科逻辑起点的最后抽象性要求;刑事案件是侦查学理论体系构建与演绎的逻辑起点。
The logic point of investigative subject means that there is an embryo category which breeds the all knowledges contains of investigative subject, is the grounds on which set up the investigative subject theories and system, as it is so an abstract, oversimplify, universal concept, in the Knowledge system investigative subject. About the recent research of the logic point of investigative subject, there are four ideas such as what is called the activity of crime, the criminal cases, criminal investigation, also the fact of crimes with natural and human features. Among them, the criminal case is the logic point of investigative subject.
