摘要
环境社会关系的特点决定了环境法调整方法是一个方法体系。传统法律方法是其中的重要组成部分,传统法律方法经过“绿化”仍然是环境法的基本方法。但是,传统法律方法不能完全适应环境法调整社会关系的需要,生态化方法就是为了弥补传统法律方法的不足而产生的环境法特有的调整方法,传统法律方法和生态化方法的组合和综合运用,形成了环境法特有的调整方法系统。
The characteristics of the environmental social relation determine that the regulative method of theenvironmental law is a system of methods, in which the traditional legal methods are the very important parts of it. Soafter being made green, the traditional legal methods are still the basic methods for the environmental law. However,the traditional legal methods cannot be completely adapted to the demand of regulating the social relation by theenvironmental law. The ecological method is a special regulative method of the environmental law generated formaking up the defect in the traditional legal method. As a result, the composition and comprehensive application of thetraditional legal methods and the ecological method build a unique regulative method system for the environmentallaw.
