摘要
经济市场化使高等学校逐渐参与市场竞争,这既给高等学校发展带来了时代机遇,也使高等学校之间的竞争加剧。高等学校之间无序的竞争行为,需要通过高等教育法制的完善来加以规范。其中权利和义务的明确性,是高等学校公平竞争立法的关键与核心内容。
With the advent of the era of knowledge economy, education industry has become a pillar industry in the national economy. The higher education is gradually involving in the market economy, which brings universities opportunities and strengthens the competition. The unordered competition among colleges and universities should be regulated by the legal system of higher education. The definition of the rights and obligation is the key of the fair comoetition Legislation.
