摘要
宪法与经济制度和经济政策的规定密不可分,国家权力配置和人权的内容也与经济政策和经济制度的规定密切相关。宪法文本明显规定的或者隐含着的对经济制度和经济政策的规定决定着宪法的本质,即是社会主义的还是资本主义的宪法、是自由民主的还是全权主义的宪法。当代宪法普遍支持对以个人为动力的市场竞争加上国家干预的综合,这不仅体现在很多国家的宪法文本对经济政策的明确规定,也体现在当代宪政结构中行政权的全面扩张,以及世界各国对以加强国家对社会财富的再分配为基础的社会性权利的普遍承认。理想化的国家干预市场的经济制度,与自由民主的政治制度构成一种伴生的关系。
Constitution and economic system and economic policy are inseparable from the provisions of the state power distribution and content of human rights and economic policies and regulations closely related to the system. The text of Constitution set forth or implied in the economic system and economic policy determine the essence of Constitution, that is it is socialist or capitalist ,free or democratic. Contemporary Constitution generally support individuals as the driving force of competition in the market coupled with a comprehensive state intervention,which is reflected not only in the text of the Constitution clearly defining economic policies in many countries, but also the comprehensive expension of administrative function in contemporary constitutional structure, and the world＇ s general recognition of the social rights to strengthen national redistribution of social wealth. Idealized state intervention in the market economic system, and a free and democratic political system constitutes a companion relationship.
