摘要
宪法思想本质上以限制公权力、保护私权利为核心,符合现代民主、自由、法治社会的历史发展潮流。它要求政府必须在宪法的轨道上行使公权力,且接受宪法的监督和制约。社会变迁与制度重构是现代化历程中的重要课题。20世纪的一个重要特征就是人类有意识地实践了两条完全不同的经济制度模式,并围绕各自的制度目标构建了不同的宪法制度体系,即计划经济与市场经济、社会主义与资本主义。这些都来源于对自由放任资本主义经济模式和纯粹私有制发展弊端的认识。厘清宪法制度变迁和经济制度嬗变的路径、模式及交互影响的关系,对于我国建设中国特色社会主义法治国家具有尤为重要的理论意义和现实意义。
Constitutional thought essentially centers on restricting public power and protecting private rights, which conforms to the historical trend of modern democratic, free and law-based society. It requires the government to act according to the orbit of the constitution, be subject to supervision according to the law and restricted by the constitution. Social change and system reconstruction are important subjects in the course of modernization. An important feature of the 20 th century was that mankind consciously practiced two completely different economic institution models, and constructed different constitutional institution around their respective system objectives, namely, planned economy and market economy, and socialism and capitalism. All these came from the understanding of the economic model of laissez-faire capitalism and the drawbacks of the development of pure private ownership. To clarify the path, mode and interaction between the changes of constitutional institution and economic institution is not only of great theoretical significance, but also of great practical significance for the construction of a socialist law-based country with Chinese characteristics.
