摘要
在中国现行的法律框架下,公安机关的行政权与侦查权被认为是两种性质的权力,由于权力性质的不同,法律为权力相对人提供的救济渠道也相应不同。对于公安机关具体行政行为不服的相对人可以通过行政诉讼寻求救济,而侦查行为则不属于行政诉讼的受案范围。针对实践中两种权力混行的现象相当普遍,研究者认为应当对公安机关的具体行政行为与侦查行为加以区别。从实践看,由于行政权与侦查权系一体警察权的两面,无论从规范层面,还是功能层面,二者均难以完全的区分。因此,更好的选择应当是建立统一的警察职权行为法体系,从警察权的整体性角度来认识公安机关的行政权与侦查权,并为二者提供统一的救济渠道。
In China＇ s existing legal framework, the executive power and the criminal investigative power of public security organs to be considered two powers with different nature. Because of the different nature of the powers, the relief channels provided by law for the relatives were also different. The relative who noncompliance with the public security organs＇ specific administrative actions can seek relief through administrative proceedings, and investigative proceedings are not within the scope of the case. Against the phenomenon of mixing the two powers in practice is quite common, the researchers believe that the specific administrative acts and criminal investigatiom conducted by the public security organs should be distinguished. From the practice, because of administrative power and criminal investigative power of the public security organs are two sides of the integrated police power, whether from the normative level, or functional level, the two are hardly distinction. Therefore, the choice should be better establish a unified system of law on the behavior of police powers, and understand the administrative power and criminal investigative power from the perspective taking the two as a integrated police power, and provide an uniform relief channels for the relatives against the two.
