摘要
数据库的传统法律保护模式面临着基本理论冲突和弱保护等无法克服的困境,因而进行特殊权利保护是实现数据库法律保护的最优进路。但是,特殊权利保护模式的正当性也受到公众的普遍质疑,因而必须重新评估习惯的力量,并在此基础上全面审视且不断完善数据库特殊权利保护模式。利益平衡机制的建立和完善必将使数据库特殊权利保护模式获得全新的生命力。
The traditional legal protection modes of database are facing some dilemma, such as the basic theory conflict and the weak protection. So the special property rights mode of databaseand will be the best outlet. But justification of the special property rights mode has also been suspected by public. We must reevaluate forces of habits , and have a comprehensive review and continue to improve the special rights mode of database.
