摘要
随着现代科学技术的发展,传统知识的价值日益得到广泛利用。在利益的诱惑下,传统知识遭到前所未有的"生物侵权",但相应的法律保护机制还未统一。发展中国家采取防御性手段只是对传统知识的初步保护,甚至是一种牺牲自我的消极方法。发达国家用现行知识产权套用保护传统知识,使传统知识时刻处于"公有领域"状态。分析这两类保护方式,传统知识的保护应另辟蹊径,根据其特点量体裁衣制定传统知识保护条例。
Along with the development of modern science and technology,the traditional knowledge value obtains the widespread use day by day.Under the enticement of benefits,the traditional knowledge encounters unprecedented＂biological right infringement＂.But the corresponding mechanism of legal protection is also not unified.The developing nations adopt the defensive method which is only the preliminary protection for traditional knowledge,even one kind negative method of sacrificing selves.The developed countries apply present intellectual property rights which cause the traditional knowledge to be at＂the public domain＂.Through analyzing these two kinds of protective ways,this paper points out we should try another way to protect our traditional knowledge,and according to its characteristics,we should make rules to protect it.
