摘要
矿业保证金制度不仅是当前许多国家按照环境责任原则确立的一项矿产资源开发利用的重要监管制度,同时也对"诊治"我国当前愈演愈烈的环境资源危机具有重大的现实意义。经济学环境资源成本内在化的需要为矿业保证金制度的确立提供了合理化的内核;对环境权社会价值属性的追求为矿业保证金的规制提供了法律制度化的要求;而发展循环经济,建立节约型社会的时代要求以及国家环境管理权的公权属性使得矿业保证金制度的实现成为可能。因此,在我国矿产资源勘探开发问题日益严峻的现实情况下,应尽快构建矿业保证金制度。
Mining guaranty fund system is an important supervisory system of mineral resources established by many countries in accordance with the principle of environmental responsibility. Meanwhile, it is of great realistic significance to China＇ s current environmental resources crisis. The needs of the internalization of environmental resources costs provides rational kernel for the establishment of mining guaranty fund system. The pursuit of social values of the environmental right provides the demands of law institutionalization for the regulation of mining guaranty fund. The demands of the era that develops recycling industries and establishes a conservation - minded society and the public right properties of the national environmental management right made it possible for the implementation of mining guaranty fund system. Therefore, we should build mining guaranty fund system as soon as possible in a current situation that problem of exploration and development of mineral resources becomes severe increasingly.
