摘要
《物权法》颁布后,对土地承包经营权予以征收补偿既是理论需要又是实践需要。在理论上,土地所有权的征收已不能消灭土地上存在的作为独立用益物权的土地承包经营权;在实践上,如不征收补偿土地承包经营权,失地农民的经济状况相比同一集体经济组织的其他成员会显著恶化。对土地承包经营权的征收补偿应以土地承包经营权的市场价格为计算标准。同时,在征地补偿时,要对土地承包经营权征收补偿与土地所有权征收补偿、安置费补助、地上附着物和青苗补偿加以区分。
The compensation policy for land expropriate must be adapted to the fact that the fight to contract for management of land is stated of real right. The land expropriate cannot eliminate the fight to contract for management of land. And the farmers lost land will be deteriorated if the fight to contract for management of land cannot be expropriated. The compensation should be based on the market price of the fight to contract for management of land. Furthermore, we should distinguish the compensation for the right to contract for management of land from land expropriate compensation, setting compensation, building compensation and green seeding compensation.
