摘要
农户的土地承包经营权是农户享有的最现实最直接的土地权利,受法律保护。国家应该在土地补偿费中设立专项,依据土地承包经营合同,对被征地农民的土地承包经营权给予合理的补偿。并通过司法救济和行政救济的方式,保障农民的这一权利。
The economic right of land contractual operation is the most realistic and most direct land right that peasant households enjoy, protected by law. The country should set up specially in the land compensation , according to the management contract of the land contract, rational compensation should be offered to those peasants＇ land contractual management right ,whose land is taken over for use. And through the ways such as administration of justice relieving and the administration relieving. ensure this right of peasants＇.
