摘要
谨慎投资者规则是指导受托人投资基金的行为指引,在美国大学捐赠基金的保值和增值过程中起到了积极作用。从谨慎人规则演变到谨慎投资者规则顺应了市场需求,体现了捐赠基金投资多样化和回报最大化的客观要求。美国大学捐赠基金的谨慎投资者规则启示我们应规范我国大学捐赠基金在资本市场的投资活动,须启动相关立法工作,完善相关法律。
as the trustee＇s standard of conduct in investing U.S. university endowment funds, the prudent investor rule has played an important role in maintaining the real purchasing power of the principal and realizing appreciation. The transition from the prudent man rule to the prudent investor rule indicts the need of market, and diversification of the endowment funds to maximize the total return on its endowment fund. This Rule tell us that it is important to begin the legislation and perfect the law relating to our university endowment funds investment, then to regulate the investment in the capital market.
