摘要
现代行政法“平衡论”通过行政关系与监督行政关系的互动实现平衡,但是在涉及主体之间、行政与环境关系、执行中所导致的结果等方面并不平衡,其提倡的以民制权论在目前可行性也不强,经历着后现代冲击的行政法也需要有新的发展思考。
The balance theory on modern administration law realizes the balance through an interaction of the administration relationship and the monitoring administration relationship. But this kind of balance is not realized in terms of the relationship between the performers, the relationship between the administration and the environment, the result caused by the execution and so forth. The thesis of the civilian-restricting power is not realistic in the operational meaning currently in our country. Experenced postmodernity the balance theory has to be improved.
