摘要
我国的劳动教养制度经历了40多年的风雨历程,发挥了历史性的作用。当前,在国家经济迅猛发展、社会处于急速转型的关键时期,人们如果从法理学的角度对劳动教养制度加以审视,就会清晰地发现它缺乏应有的合法性、合理性和正当性,因而总体上是违反法治和侵犯人权的。因此,改革和完善劳动教养制度迫在眉睫。
The reeducation- through - labor system has experienced more than 40 years in our country, meantime it plays a historical role in its development. Currently, in the critical stage of nation's economy booming, and society's sharp transferring, from the point of view of law, if we analyze on the reeducation - through - labor system, we will clearly find out it Lacks due validity, reason and justice. It is totally breach the rule of law and infringe upon human rights. Therefore, reforming and perfecting the reeducation-through -labor system is the most urgent thing.
