摘要
互联网技术的兴起和发展,使著作权体系产生了扩张的趋势,加之技术性保护措施的合法化,合理使用原则面临边缘化的危机。对此,该文从网络所具有的“后现代特性”与合理使用原则的价值基础“效益主义”着手,从利益平衡的角度,探讨了合理使用原则调适的基本走向,并对我国相关的立法进行了评析。文章认为,合理使用制度在网络环境下应适度扩大适用范围,以契合网络的“后现代特性”所主张的互动与开放精神,以及以利益平衡为内核的“效益主义”目标。
With the rise and development of Internet technology,the Copyright scheme tends to expand.In addition to the legal application of technical protection measures,it will lead to the weakening of function of fair use doctrine.Therefore,this paper discusses the trend of adjustment of fair use doctrine in cyberspace and analyzes Chinese related legislation by examining the 'postmodern nature' of Internet,the fundamental value 'utilitarian' and the perspective of interests balance.In conclusion,it holds that the range of application for fair use doctrine should be reasonably expanded,in order to correspond to the interactive and open spirits of the postmodern nature of Internet and the purpose of utilitarian principle based on interests balance.
