摘要
病人权利是在医患矛盾比较突出的情况下凸现出来的,它具有人权的基本特征,但在自主决定权上面具有先天的缺陷;医生作为病人权利的义务人之一在医患关系中处于特殊的垄断地位。本文分析病人权利的历史演变,归纳病人权利的基本内容,提出在医患关系中把病人权利简单归纳为就医权和监督权两类,并采用不同的委托代理方式,发展竞争性的健康保险或第三方健康管理组织在理论和实践上将有利于形成更新型的医患关系,保护病人权利,找准医改的突破口。
Along with the immerging of physician - patient confliction in China, the rights of patient which have the basic characteristics of human rights, were considered by publicans in a high scale. But the right of autonomy of patient has its inherited deficiencies, as the doctor has a monopoly state in the physician - patient relationships. By analyzing the history and contents of patient~ right in the fields of physician - patient relationships in China, we make an assumption of decomposing the patient's right into two types of right, the right of seeing a doctor, the right of supervising. It will help ease up the physician -patient confliction by entrusting these rights to physician and different types of the third side respectively, among which the development of competitive health insurances in the health service system is a key solution way.
