摘要
高校自主权是法律范围内的自主权,从本质上说是高校在法律范围内的自由裁量权,其性质为公权利,其载体是高校法人;其有效性决定于法律规定的范围和学校的定位。
The autonomy of the higher educational institutions, in essence, should be defined as the autonomy prescribed by the law and as the discretion exercised by the higher educational institutions within the bounds of the law. The nature of this autonomy belongs to public rights, the carrier for this autonomy is that of the juristic person for the higher educational institutions, and the validity for this autonomy is determined by the scope of business stipulated by the relevant laws and regulations, as well as the orientation of the higher educational institutions.
