摘要
土地是重要的自然资源,土地价值的发挥不仅依赖于政府,更依赖于市场。在土地征用的过程中,由于立法的缺陷,致使集体利益得不到有效保护。要改变这种现状,必须对我国土地征用的基础理论进行创新,并对具体的部门法进行修改,充分发挥政府的宏观调控与市场的激励作用,以此来推动我国土地征用的规范化进程。
Land is one of the essential natural resources. How the value of land can be maximized depends not only on governments but also markets. In the course of land requisition collective interests aren＇ t effectively protected due to the defects of lawmaking. Therefore, new ideas must be introduced to the basic theory of land requisition, the existing branch law must be amended, and the macro regulation and control of governments and the invigoration of markets will be put to good use, so as to accelerate legal step of land requisition in China.
