摘要
农村土地国有化是在我国现实基础上的最佳选择,制度转换的路径是:国家以法律形式宣布所有土地为国家所有,取消农村土地的集体所有,农民现在承包的土地使用权归农民,使用年限为40年,到期后所有土地由国家无偿收回。
It is the best choice to nationalize the rural land in our country. This article analyses the problem of rural land institution in our country and points out that rural land nationalization is the best choice. The manner of institutional change is that the state should declare with law the nation ownership of the rural land and that the state should abolish the collective ownership of rural land. The usufruct of the rural land should belong to those who contract with it for 40 years. After that term, it should be taken back without any cost by the state.
