摘要
在农村集体产权制度改革背景下,要做到“坚持农民集体所有不动摇”,首先须破除“过渡论”和“激变论”两种认识。集体所有制是由农民所有制突变而来的,集体所有的实践史证明集体所有制是符合我国社会主义初级阶段的生产力发展水平的。集体所有制具有坚实的宪法基础,在社会主义初级阶段须长期坚持。全民所有制是一种“大公有制”,集体所有制是一种“小公有制”。集体所有的“小公有”属性体现为集体单独所有与集体成员共同所有的结合,其主体具有多元分散性。集体成员对集体资产的共有应界定为公有制基础上的按份共有而非共同共有。不同的集体之间可以共有公有土地体现了“小公有”具有“私”的成分。集体成员资格的确定应打破传统思维,实现集体成员身份由隶属性向财产性的转变。
Under the background of rural collective property right system reform,in order to“adhere to the farmers’collective ownership unswervingly”,we must first break away from the“transition theory”and“drastic change theory”.Collective ownership is a sudden change of peasant ownership.The practical history of collective ownership proves that collective ownership is in line with the development level of productive forces in the primary stage of socialism in China.The constitution must be firmly based on collective ownership in the primary stage of socialism.Ownership by all people is a kind of“big public ownership”,while collective ownership is a kind of“small public ownership”.The attribute of“small public ownership”of collective ownership embodies the combination of collective individual ownership and collective member joint ownership,and its subject is diversified and decentralized.The co-ownership of collective assets by collective members should be defined as co-ownership by shares on the basis of public ownership rather than common co-ownership.Different collectives can share public land,which shows that“small public ownership”has“private”component.The determination of collective membership should break the traditional thinking and realize the transformation of collective membership from subordinate to property.
