摘要
佘祥林案暴露出在刑事侦查的过程中,缺乏必要的法律监督。如何加强人民检察院对刑事侦查工作的法律监督,已经成为了一个重大的理论问题和迫切的现实问题。应当针对目前存在的问题和困难,建立“以公诉为中心,检察指导侦查”的模式,从多方面加强和完善对刑事侦查的法律监督,在制度设计上避免冤案的重演。
SHE Xiang- lin case exposes that the investigating course lacks essential legal supervision criminally.How to strengthen the legal supervision of criminal investigation of people＇ s procurator ate, has already become a great theoretical question and urgent realistic problem. In order to against the existing problem and difficulties at present, the mode of “regarding prosecuting as the center, procurator work guiding investigating” should be set up, the criminal legal supervision should be strengthened and perfected from many aspects, avoiding the recurrence of the unjust verdict on system design.
