摘要
在法治国家的刑事诉讼结构中,检警关系模式应当充分体现宪政主义诉讼价值理念,即有效控制警察行为的合法性,打击犯罪与保障人权并重。侦检一体化模式的确立,成为刑事诉讼结构近代化的重要标志,对于巩固国家宪政基础和法治秩序具有历史性意义,不仅有利于刑事诉讼目的的顺利实现,也为检察制度的健康发展创造了必要的前提条件。
The mode of the relationship between the police agency and the procurator office should embody the procedural value of constitutional governments in the criminal proceeding structure of legal states: to control the legality of the police action effectively, to punish crimes and protect human rights equally. On this base, the establishment of systematic mode of investigation and prosecution will become an important landmark of modernization of criminal proceeding structure and will have historic effects on strengthening the bases of constitutional government and the order of legal states. At the same time, it will facilitate the achievement of criminal proceeding intent and create the necessary premise for the healthy development of the procuratorial institution.
