摘要
网上欺诈已成为电子商务中侵害消费者权益最为严重的现象,具有影响面大、传递速度快、技术含量高、成本低以及不易于识破的隐蔽性特点。它的存在是电子商务自身属性、政府监管不足、企业信用差以及消费者自我保护意识弱的结果。为防止网上欺诈,不仅要结合国际规则,借鉴各国先进立法例,完善反欺诈法律法规,健全政府对电子商务的监管机制,而且还应倡导建立行业自律机制,增强消费者的自我保护意识。
As the most serious phenomenon infringing consumer′s rights and interests in electronic commerce,fraud on the network is characterized by wide influence,quick transfer,high technical,low cost and concealed.Its existence is the consequences of the attribute of e-commerce itself,insufficient supervision from government,poor in credit of enterprise,and weak in consumer′s sense of self-protection.In order to prevent from fraud on the network,it needs to perfect law and regulation against fraud and to improve mechanism of government supervision of e-commerce by combining with international regulation and learning from advanced legislative examples of othar countries;it also has to initiate the formation of professional mechanism of seif-discipline,and to enhance cunsumer′s sense of self-protection.
