摘要
为了研究怎样认定体育课和课外体育活动中学生伤害事故的责任 ,本文运用民法及相关法律 ,对典型案例进行分析。提出学生伤害事故的责任认定 ,应以民法中关于民事责任的归责原则为依据 ,以过错责任原则为主 ,公平责任原则为辅 ,按照不同伤害事故的类型 ,分清责任 ,明确责任承担者 ,公正合理地处理事故 ,充分保护学校、学生、家长各方的合法权益 。
In order to study how to identify the liability of injury accidents in physical education class and physical activities after class This article, using civil law as well as other law, analyses some typical cases, poses liability identification of accidents which is based on identification principle of civil liability It's mainly the principle of fault liability with fair liability According to different type of accidents, confirm one among them who is wrong and who is responsible for, and handle accident reasonably and protect fully the lawful right and interest in every aspect, not only in school but also the students and their parents, to ensure teaching in good order
