摘要
最低价中标法是国际上通行的一种具有较高市场效率的工程招标方法。2003年7月1日在我国开始实施的“工程量清单”招标方法,被视为推行“最低价中标法的前奏”。国内有些地区也已经全面实施或正在积极试点“经评审的最低价中标法”。面对政策导向、制度变革趋势和市场发展趋势,研究最低价中标法,具有十分重要的理论意义和现实意义。本文通过最低价中标法的博弈论基础、厦门市的改革实践,以及笔者在福建省教育系统的工程实践,分析了最低价中标法的理论优势、现实意义、作用和实施条件。理论分析和实际应用表明,最低价中标法是一种理论上最优,实际中可行的建设工程招标方法,应该成为我国建设工程交易制度与国际惯例接轨的目标之一,应该在积极创造条件的基础上推动这项制度真正实施。
