摘要
文章结合分析美国对商业方法专利态度的历史嬗变,认为一国对商业方法专利采取不同态度的深层原因是不同时期国家对相关经济利益的平衡需要。并联系我国现实情况,对我国目前不授予商业方法专利的原因予以剖析,对我国商业方法可专利性问题的发展趋势作出预测,同时对提高我国商业方法专利质量提出若干建议。
By reviewing and analyzing the history of US's attitude towards business method patents, this article argues that the deep-seated reason of different attitudes of different countries towards business method patents is the national economic benefit balance in different periods. Considering China's status quo, this article advances to analyze the reason for the refusal of business method patent in China, forecast the development trend of the patentability of business method in China, and bring forward some suggestions of improving the quality of business method patents.
