摘要
氏族在中国古代社会文明化的进程中长期存在,氏族结构在进入国家的过程中并没有消失,而是在社会变迁的运动中逐步地演变成了公族、家族的形态,对中国传统法律在法律架构、法律精神、法律规范形式上产生了极深刻的影响。
In the course of social civilization of China, the clan structure had existed for a long time and became patrician and family clan, so we call the Chinese antique society as a clan society, which had great effects on Chinese traditional law system, including the structure, the spirit and the form of the laws.
