摘要
近年来 ,出现多起高校与学生之间的法律纠纷 ,矛盾激烈者甚至诉至法院 ,寻求司法权的干预。社会各界对此类案件的性质理解各异。本文认为高校与学生之间的法律关系应置于一定的时空中作具体分析。入校时主要是民事法律中的合同关系 ,在校期间主要是内部管理关系 ,离校时主要是行政法律关系。依据法律关系的不同性质寻求解决纠纷的途径。
In recent years ,more and more legal issues between universities and the students occurred. Some serious applied to the court for justice .Public opinions on the nature of these cases are different. This article regards that the legal relationship between universities and the students should be concretely analyzed according to the specific circumstance. The relationship is of the civil contract when entering the college ,the inner supervision when in school,the administrative one when graduation. We should devise methods of solving issues according to different natures of the legal relationships.
