摘要
民间社会团体的广泛兴起造就了一场全球社团革命 ,它反映了全球化时代国家与社会、权利与权力均衡互动发展和权力回归社会的当代走向 ,并形成了良性互动的新型权力制约与权利保障机制 ;增进了市场经济条件下的自生自发秩序 ;促进了全球化时代的法治范式转换 ;推进了全球法治秩序的形成。中国社会团体则在政府职能转变、市场经济转型和民主法治建设中 ,成为推进良性社会分权、促进社会自律管理、维护转型期社会稳定、加快民主法治进程的重要社会力量。
The extensive rise of civilian social organizations brings up a global association revolution, reflecting the development of equilibratory reactions between the state and the society, the right and the power, and the modern trend of power's reverting to the society in the globalization time. It also brings into being a new and well-reacting mechanism to restrict the power and to guarantee the right; and increases the spontaneous order under the market economy; and promotes the transformation of legal rule model in the globalization time, with a global legal rule order in the process. Chinese social organizations, against the context of the transformation of the functions of government, of the market economy, and of the establishment of democracy and legal rule, also becomes an important social strength to promote the good separation of the power and the self-disciplined administration by the society, to maintain the stability of the transforming society, and to promote the democracy and legal rule.
