摘要
著作人身权的转让问题在我国争论已久。《著作权法》修改以来 ,法学界对这一问题的讨论更加激烈 ,其范围已从某种著作人身权能否转让扩展到著作人身权的全部。著作人身权虽然在取得、内容、保护等方面不同于民法的人身权 ,但民法人身权的不可转让性同样适用于著作人身权。著作人身权可以放弃 。
Abstract:Transfer of copyright in persona has been discussed for a long time. The amendment to the Copyright Law has caused heated discussion on transfer of one or several categories of copyright in persona, this leads to a further debate on whether copyright in persona is transferable as a whole. Although personal right in civil law is different from copyright in persona in acquisition, contents, protection and other aspects, its non-transferable applies to copyright in persona. Copyright in persona can be abandoned, but it should not be transferred.
