摘要
现代行政主要表现为自由裁量行政 ,但其膨胀和错位对依法行政构成了极大的威胁。在中国行政法治建设中 ,只有在权力设定阶段、运作阶段及审查阶段对行政自由裁量权进行全方位的合理性监控 。
The main manifest of the modern administration i s the freely deceisive right of administration,but its inflation and dislocation h ave greatly threaten administration by law.During the establish of Chinese admin istration,only overall supervising the freely decisive right of administration o n the power-designing-stage,demonstrating-stage and examining-stage can rule -by-the-administrative-law in the strict sense be realized essentially.
