摘要
诚实信用原则乃民法中的"帝王条款"，具有一定的法律漏洞补充的功能，在民法领域中被极力推崇。诚实信用原则在法律制度(不仅仅是民事领域内)中的渗透，实际上是在人与人之间的法律关系中设立了一种对应的义务--使人信赖的义务。就目前而言，诚实信用原则在合同法中得到较为彻底的施行。在其他领域，该原则虽没有被着重关注，但实际上也或多或少地存在着。因此，在社会迅速发展的今天，诚实信用原则不仅是民法的"帝王条款"，而且在相关领域也大有其适用的空间。这已在相关立法中得到体现，其地位应有所上升，且现实意义更不能被低估。在讲究信用的市场活动中，应重视其在法律中的地位，扩展其适用的范围，完善我国的司法制度，促进司法公正、公平、有效。政府在企业建立信用体系中应起重要作用，要加快健全符合市场经济体制要求的社会信用法律制度；要加快转变工作职能的步伐，疏通系统内的体制关系，尽快为企业提供一个公平竞争的发展平台；要加大对企业诚信失缺的惩罚力度，为企业搭建较透明的信息平台。此外，还要进一步完善产权制度，进一步规范政府行为，加大欺诈方的失信成本，建立面向个人、企业的诚信评价和发布机构，建立一个完善的信息交流与沟通的机制。
As the 'emperor's clause' in the civil law,the honest credit principle has certain function with supplementary legal loophole,praised highly in the field of civil law utmostly.The infiltrations of the honest credit principle in legal system (not merely in the civil fields)has set up a kind of corresponding obligation in the interpersonal legal relation in fact -the obligation of making people rely on .For now,the honest credit principle gets comparatively thorough implementing in the contract law.In other fields,although this principle is not paid close attention to emphatically,this principle exists more or less in fact.So,today when the society develop rapidly,the honest credit principle is not merely a clause of emperor of the civil law ,and has much suitable room in the relevant field .This has already been embodied in the relevant legislation,its position should rise to some extent ,and the realistic meaning can't be underestimated still more .In paying attention to the market activity of credit ,should pay attention to its position in the law ,expand its suitable,perfect the judicial system of our country,promote the judicial justice fair,effective.The government should play an important role iv setting up the credit system in the enterprises ,should accelerate the social credit legal system according with the request of market economic system.Should accelerate the paceses that change the working function,dredge the structure relations of the system,offer a fair competition development platform for enterprise as soon as possible.Should increase the punishment for the enterprises' losing hones,put up the relatively transparent information platform for the enterprise.In addition,will perfect the property right system and standardize the government behavior further,strengthens the cost of breaking one's promise,set up the organizations that appraise and issue the sincere facing to individual,enterprise,Set up a perfect information interchange and mechanism of linking up.
