摘要
制定物权法必然受我国现行的《民法通则》的体系及其他各种民事单行法的规定及传统法律思想之影响 ,建议制定中国物权法必须遵循客观理性规则在物权变动及其公信力、埋藏物之发现制度与遗失物之拾得制度方面以及使用的术语上进行修正补缺 。
The system of General Principles of the Civil Law of the People′sRepublic of China, other special stipulations by law in civil activities and traditional Chinese legal idea will inevitably influence the present legislatio n of Rreal Right Law of tile People′s Republic of China We must be in accorda ncewith principles of objectivity and reason to modify and replenish stipulations a s regards the public confidence in the alteration of real right, discovering of buried or lost chattels without ownership and terms, at the same time drawing u pon relevant experience in lawmaking of nations belonging to Anglo-American LawSystem or Common Law Legal System
