摘要
今年是我国《海商法》实施十周年 ,值此机会 ,作者分析了海商法实施以来的具体情况并总结了国际和国外立法中的相关经验。在分析我国海事立法现状的基础上 ,从几个不同的侧面 ,论证了我国海上货物运输法律实行双轨制给海运司法实践所带来的负面影响 。
This year is tenth anniversary of the enforcement of Maritime Code of China. The author took this opportunity to analyze the specific conditions under which the Maritime Code is enforced and summarized the relevant experience of international legislation and that of foreign countries. On the basis of analysis in respect of present situation of maritime legislation in our country, the author demonstrated from different aspects the bad influence caused by dual system of law to the maritime judicial practice and the significance of unification of legislation. Furthermore, the suggestion for unification of the law is put forward for solving the problems of 'dual system ' in the maritime legislation.
