摘要
激情的民主和理性的法治之间存在着一定的紧张。二者之间有相互促进的地方,但并不如人们所普遍认为的那样天然统一。本文首先从理论及实践上对二者的关系进行了分析,然后以足球"黑哨"问题为例证,从法律的视角对二者关系进行了进一步思考,认为树立法律权威、确立法律信用是民主的法治要求,权力制约与权利保障是法治的民主要求。二者在一定条件下可以达到统一。
There's some tension between democracy which is characteristic of passion and 'rule of law' which is characteristic of reason . Although they can promote each other,they are not naturally concordant as people always think. The article first analyzes the relationship from theories and experiences of countries,and then analyzes it further from the visual angle of law on the example of the problem of 'black whistle' in the soccer. finally,tearticle comes to the conclusion that democracy has its needs of rule of law to build the authority of law and establish the credit of law,and rule of law has its needs of democracy to restrict powers and protect rights,so,under some certain conditions,the two will be harmonious.
