摘要
作为依法治国的关键,依法行政必以完善的行政法律体系为基础和前提。完善的行政法体系的建立,有赖于对行政 法的功能和价值的准确领会与把握。行政法的功能和价值在于:通过平衡行政机关与相对方的利益,协调二者之间的关系。 以形成和维护社会发展所需要的社会秩序。这种平衡是通过行政法对行政权的规范来实现的。
As the key of 'ruling the country by law', administration by law must regard perfect administration law system as its foundation and premise. To establish the perfect administration law system depends the accurate understanding about the function and value of the administration law. Its function and value lie in; through holding the balance of interests between administrative organizations and opposites, to moderate their relation to form and maintain the social order. The equilibrium is a result of standardization of the administration law to the administrative power.
