摘要
理论上 ,矿业权具有特权属性 ,是在矿产资源之上设定的用益物权 ,属于不动产范畴。通过立法确认矿业权物权属性 ,完善和建立矿权法定、一矿一权和公示公信制度 ,以维护矿产资源所有人和矿业权人的利益 ,促进矿产资源合理开发和利用。
Theoretically,mining rights has property attribute,and belongs to real property,which is set up as use rights of mineral resources.In order to maintain the benefit of mineral resource owner and mining rights holder,and to promote proper exploitation and utilization of mineral resources,the property attribute of mining rights should be identified by legislation,and the legal system,public system and inpartial system of mining rights should be established and developed.
