摘要
劳动权同其他宪法基本权利一样需要司法程序的保障。我国劳动争议的仲裁和诉讼的范围过于狭窄 ,争议解决程序不利于劳动权的保护。随着市场经济的深入运行和人权事业的发展 ,我国劳动争议的仲裁和诉讼的客体既包括所有的个体劳动权 ,也应当包括集体劳动权 ;劳动争议的仲裁和诉讼的主体应当具有普遍性 ;改革劳动争议解决机制 ,重新分配举证责任 ,既注重了劳动权的安全 。
Labor rights need to be protected by justice procedure as other principal rights of Constitution. The range of arbitration and litigation of labor disputes is too narrow, and the procedure goes against the protection of labor rights. Along with the development of market economy and of human rights, the objects of the arbitration and litigation of labor disputes of China include not only the individual labor rights but also the collective labor rights. And the subjects ought to be universal. It is necessary to rebuild the mechanism of dispute settlement and redistribute the onus probands,which does good not only to the security of labor rights, but also to the benefits of labor rights.
